What is an accessory structure?

A detached, subordinate building, the use of which is incidental to the main building or use of the land. These typically include sheds, greenhouses, and decks. An accessory structure does not include habitable living space.

What can I do without getting a building permit?

Your structure needs to be 200 square feet or less, no taller than 10 feet high, and a minimum of 3 feet from the property line. You will still need a Type A Permit. 

Is a tiny house considered an accessory structure?

No, an accessory structure does not include habitable living space. All accessory structures should not have electricity or running water. Contact Aumsville City Hall for more information on these types of structures.

My neighbor has a fence that doesn't meet these guidelines, why are they allowed something different?

It may be that the fence was built without following the ordinance. They may be subject to fines and/or the expense of removing their fence if it’s out of compliance. There are also non-conforming, pre-existing fences.

Why do we have these rules?

The main reason for not allowing taller fences in the front yards is for public safety. Clear vision is based on someone being able to see a pedestrian or obstacle when pulling out, thereby avoiding a potential accident.

I spoke with someone at City Hall and they told me I could build my fence this way?

It’s the owner’s responsibility to follow the local ordinances. Question and answers are often misinterpreted, and that does not excuse a code violation.

Can I plant trees or shrubs to screen the front yard?

Yes, however shrubs must be maintained below 36 inches if they are within the first 20 feet. Trees must be trimmed clear up to 8 feet. The placement of trees should not interfere with utility poles, light standards, power lines, etc.

Can I build a fence taller than 7 feet in my back yard?

Yes, you will need a building permit for any fence above 7 feet. Contact City Hall for details.
