Time Extension of Approval of Site Development Review (SDR 18-03)

 

for property located:

8712 Aumsville Hwy SE

A public hearing for this application has been set before the Aumsville Planning Commission on Thursday, May 21, 2020, at 6:00 PM. The hearing will be held at the Community Center, 555 Main St, Aumsville, OR.

 

As a result of the novel infectious coronavirus (COVID-19) creating a threat to public health and safety, interested parties are advised to provide public input by mail: 595 Main St., Aumsville, OR 97325.

The application was submitted by Recology Oregon Compost to extend an approval for Site Development Review (SDR 18-03) for a period of three years.

 
The applicable criteria are set forth in Section 21.07 of The Development Ordinance as follows:

Section 21.07(B) The planning Commission shall upon written request by the applicant and payment of the required fee, grant an extension of the approval period for a period not to exceed a total of 5 years from the Original Site Development Review Notice of Decision, provided that:

 

No major modifications are made to the approved site development review plan;
The applicant can show intent to initiate to complete construction on the site within the extension period;
There have been no changes to the applicable ordinance provisions on which the approval was based. If there have been changes to the applicable ordinance provisions and the expired plan does not comply with those changes, then the extension shall not be granted; in this case, a new site development review shall be required; and
The applicant demonstrates that failure to obtain building permits and substantially begin construction within 2 years of site development approval was beyond the applicant’s control.

 
A copy of the application, all documents and evidence submitted by or on behalf of the applicant, and applicable criteria are available for inspection at Aumsville City Hall for free or may be requested at a per copy cost with a public record request form. A copy of the staff report will be available for inspection at no cost at least 7 days prior to the hearing and a copy will be available at a per-copy cost. Additional information may be obtained from City Administrator, Ron Harding at (503) 749-2030. Written testimony to be included in the public record must be directed to his attention, at City Hall: 595 Main Street, Aumsville, Oregon 97325, or presented at the hearing.

 

Written and verbal testimony is to be directed toward the criteria. Anyone wishing to testify at the hearing must sign in and ask to be recognized. The hearing will be conducted with the staff presentation first, followed by the applicant’s case, testimony of persons in favor, opposing testimony, governmental agencies testimony, general testimony, rebuttal, questions, and summaries before the hearing is closed. Failure to raise an issue in person or by letter prior to the close of the public hearing with sufficient specificity to provide the Aumsville Planning Commission opportunity to respond to the issue, precludes appeal to the Aumsville City Council on this issue.
